1. Your Relationship with Us
Welcome to 靈籤小廟 (also referred to as "Muyu", the "App" or the "Services"). The App is provided by Wicheer limited, whose registered office is located in Hong Kong (such entity is referred to as "we", "us" or "our"). These Terms of Service (the "Terms") govern your relationship with us and your access to and use of the App and its related services (collectively, the "Services").
The Services are provided for personal, non-commercial use. By accessing or using the Services, you agree to be bound by these Terms. Please read them carefully.
2. Acceptance and Age
By accessing or using the Services, you confirm that you are legally capable of entering into a binding contract and that you accept and agree to abide by these Terms.
The Services are intended for users aged 13 or older. If you are under the age of 13, you may not use the Services. If you are a parent or guardian and believe that a child under the age of 13 has used the App, please contact us immediately so that we can take appropriate action.
Please also read our Privacy Policy, which explains how we handle your personal information. Your continued use of the Services constitutes your acceptance of these Terms.
3. Changes to These Terms
We may amend these Terms from time to time. We will use commercially reasonable efforts to give all users reasonable notice of material changes, such as through notices in the App, and we will update the "Last Updated" date at the top of these Terms. Your continued use of the Services after the new Terms take effect indicates your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
4. Your Account
To use the Services, the App creates an account for you based on a device identifier. Your account is personal to you. You are responsible for (1) protecting access to your account and your device, and (2) all activity that occurs under your account. If you suspect that your account has been compromised, please contact us promptly.
User identifiers assigned by us in connection with the Services remain our property, and we may disable, recycle or reuse them after your account is terminated or deactivated.
We may suspend or disable your account at any time if you breach these Terms, or if your use of the Services causes or may cause harm, damage or violation of any third-party rights or applicable laws or regulations.
5. Content and Conduct
5.1 Content you provide. When you use the Services, you provide certain content, including the fortune slips you draw and the text you enter during slip interpretation ("Your Content"). You retain ownership of Your Content. You grant us and our affiliates a non-exclusive, royalty-free licence to use, store and process Your Content as necessary to operate, improve and maintain the Services, in accordance with our Privacy Policy.
5.2 Content about other people. If you use the "ask about another person" feature, you must not enter another person's personal information unless you have their consent. You are solely responsible for any personal information about others that you provide.
5.3 Nature of the Services. The Services provide traditional fortune-slip drawing and AI-assisted interpretation for entertainment purposes only. Slip interpretations are generated on our servers with the assistance of Amazon Bedrock, Amazon Web Services' (AWS) managed large language model service; the text you enter and your birth details are transmitted to AWS for this purpose, as described in our Privacy Policy. The content generated by the Services is based on traditional folk culture and does not constitute professional advice (including but not limited to legal, financial, medical, psychological or other professional advice), and is not a guarantee of any particular outcome. You should not make decisions based on the content generated by the Services. You agree that the Services are not a gambling, betting or lottery service: no real-money prizes are offered, and virtual coins you purchase cannot be withdrawn or redeemed for real money or value.
5.4 Prohibited activities. You agree not to engage in any of the following in connection with the Services:
- Reverse engineer, decompile, disassemble, copy, modify or create derivative works of the App or attempt to identify its source code, except as permitted by applicable law;
- Use automated bots, crawlers, scripts or other automated means to access, scrape or interfere with the Services;
- Use the Services for any fraudulent, misleading or deceptive purpose, or in violation of any applicable law or regulation;
- Attempt to interfere with or overburden the servers that support the Services;
- Introduce viruses, worms, Trojan horses or other malicious code;
- Impersonate any person or misrepresent your affiliation with any person or entity.
6. Disclaimer of Warranties
The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, we make no warranties or representations regarding the Services, including that: your use of the Services will meet your requirements; the Services will be uninterrupted, timely, secure or error-free; or the content generated by the Services (including fortune readings) is accurate, reliable or otherwise reflects reality.
Nothing in these Terms affects any rights you have under law that cannot be waived or varied by agreement.
7. Scope of Liability
Nothing in these Terms excludes or limits our liability for anything that may not be legally excluded or limited by applicable law, including death or personal injury caused by our negligence, and fraud or fraudulent misrepresentation.
To the maximum extent permitted by applicable law, we will not be liable to you for:
- Loss of opportunities, loss of goodwill, or indirect or consequential loss;
- Loss of data arising from your use of the Services;
- Any changes to, or permanent or temporary discontinuation of, the Services or any feature;
- Your failure to keep your account details secure or to provide accurate information;
- Any loss or damage arising out of your use of, or reliance on, the content generated by the Services (including fortune readings).
To the extent we are liable to you, our aggregate liability arising out of or in connection with these Terms will not exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the liability.
8. Payments and Virtual Coins
8.1 In-app purchases. Some features of the Services (such as additional slip interpretations) require virtual coins. Virtual coins are purchased as consumable in-app purchases processed by Apple's App Store (iOS) or Google Play (Android). Your purchase is subject to the applicable app store's terms of service and its refund policy.
8.2 Non-refundable. Unless otherwise required by applicable law in your jurisdiction, virtual coins are non-refundable after purchase, whether used or unused. Deleting your account does not entitle you to a refund of unused coins.
8.3 No monetary value. Virtual coins are a licence-limited measure of entitlement to use the Services. They have no monetary value, cannot be transferred, and cannot be exchanged, redeemed or withdrawn for real money or any other consideration. We may change the pricing, availability and coin quantities of products from time to time.
8.4 No real-money gambling. The Services do not involve betting, staking or winning real money or prizes.
9. Intellectual Property
All intellectual property rights in the App and the Services (including any future updates, upgrades and new versions), and in the fortune-slip content, artwork, text, graphics, audio and trademarks displayed in the App, belong to us or our licensors. You have no right to use our trademarks, logos, product names or other brand features without our prior written consent. Any comments or suggestions you make about the Services are entirely voluntary, and we are free to use them without obligation to you.
10. Third-Party Services
Your in-app purchases are processed by Apple App Store and Google Play. Slip interpretations are generated with the assistance of Amazon Bedrock, Amazon Web Services' (AWS) managed large language model service, to which relevant interpretation text and birth details are transmitted as described in our Privacy Policy. We are not responsible for, and do not guarantee, the services of these third parties. When you use third-party services through the App, you must comply with the terms and conditions that apply to those services. Apple and Google are not responsible for the App or its content.
11. Updates
We may in our sole discretion distribute corrections, updates and upgrades to the App ("Updates"). You agree to receive and install Updates. If you do not install Updates, the App may not operate correctly. We do not warrant that Updates will be provided, or that they will continue to support your device or operating system version.
12. Termination and Account Deletion
We may temporarily or permanently suspend or terminate your account, or restrict your access to all or part of the Services, with or without notice, if: we reasonably believe you have violated these Terms; your activities may cause harm to us or the Services or infringe third-party rights; we are responding to requests from law enforcement or government agencies; or we encounter unexpected technical or security issues.
You may stop using the Services and delete your account at any time:
- In the App: go to the account screen and tap "Delete Account".
- On the web: visit the account-deletion page at https://shrine-h5.saree3.live/delete-account.html and follow the email steps there, or email us directly at developer@mail.saree3.live.
Once you delete your account, you will not be able to recover it or its records, and you will lose any remaining virtual coins.
13. Applicable Law and Dispute Resolution
Unless otherwise required by the applicable laws and regulations of your jurisdiction, these Terms and any dispute or claim arising out of or in connection with them shall be construed and governed by the laws of Hong Kong.
14. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. No delay in enforcing a provision shall be construed as a waiver. You may not assign or transfer these Terms or any rights or obligations under them without our prior consent. We may assign or transfer these Terms to any of our affiliates or to a successor in a merger, acquisition or similar transaction.
15. Child Protection
We are committed to protecting children. The Services are intended for users aged 13 or older, and we do not knowingly collect personal information from anyone under 13 (see our Privacy Policy). If you believe a person under 13 is using the App, please contact us immediately.
Supplementary Terms for App Stores
To the extent permitted by applicable law, the following supplementary terms shall apply.
Apple App Store
By accessing the App through a device manufactured by Apple Inc. ("Apple"), you expressly acknowledge and agree that:
- Apple is not a party to these Terms with you.
- The licence granted to you under these Terms is limited to the personal, limited, non-exclusive, non-transferable right to install and use the App on Apple devices that you own or control, for personal and non-commercial use, subject to the App Store Terms of Service.
- Apple is not responsible for the App or its content, and is not liable for any maintenance or support services related to the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the App to the maximum extent permitted by applicable law.
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, or claims under consumer protection or similar legislation.
- If any third party claims that the App or your possession or use of the App infringes that third party's intellectual property rights, Apple is not responsible for investigating, defending, settling or discharging such claims.
- You represent and warrant that you are not located in a country embargoed by the U.S. government, and that you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Google Play
By downloading the App from Google Play (or its successor) operated by Google Inc. or one of its affiliates ("Google"), you expressly acknowledge and agree that:
- The Google Play Terms of Service, the Google Play Business and Program Policies, and any other terms that Google designates as default and user licence terms for Google Play (collectively, the "Google Play Terms") apply to your use of the App downloaded from Google Play, together with the other terms in these Terms.
- Google has no responsibility or obligation for the compliance or non-compliance of us or you under these Terms or the Google Play Terms.
